Trackdock Limited trading as Trakroom (“Trakroom,” “we,” “us,” or “our”) respects the intellectual property rights of creators, artists, producers, businesses, and other rights holders.

Trakroom is a digital platform that enables creators and businesses to upload, showcase, license, sell, distribute, and otherwise provide digital content and creative works to customers.

We take allegations of copyright, trademark, and other intellectual property infringement seriously. This policy explains how rights holders can report alleged infringement and how users can respond when their content has been removed or restricted.

1. Copyright Complaints
Trakroom may respond to valid copyright complaints concerning content made available through the Trakroom platform.

Examples of potentially infringing activity include:

*Unauthorized uploading or distribution of copyrighted music, beats, instrumentals, recordings, images, videos, artwork, or other creative works.
* Unauthorized sale or licensing of copyrighted material.
* Uploading content without the necessary rights, permissions, or licenses.
* Unauthorized use of copyrighted material in digital products offered through Trakroom.
* Other activities that may infringe a third party’s copyright.

Not every unauthorized use of copyrighted material necessarily constitutes infringement. Certain uses may be permitted under applicable law, including applicable exceptions or limitations to copyright.

If you are unsure whether you own the rights to material or whether a particular use constitutes infringement, you should consult an attorney or other qualified legal adviser.

2. Before Submitting a Copyright Complaint
Before submitting a copyright complaint, you should carefully consider whether the reported use is actually infringing.

You should also ensure that:

  1. You are the copyright owner; or
  2. You are legally authorized to act on behalf of the copyright owner.

Submitting a knowingly false or materially misleading copyright complaint may expose the reporting party to legal liability.

Trakroom reserves the right to take appropriate action against individuals who repeatedly submit fraudulent, abusive, or knowingly inaccurate intellectual property complaints.

  1. Information Required for a Copyright Complaint

To help us process a copyright complaint, please provide the following information:

3.1 Signature
A physical or electronic signature of the copyright owner or an authorized representative.

3.2 Identification of the Copyrighted Work
Provide a description of the copyrighted work that you believe has been infringed.
Where possible, provide a link to the original work or other information establishing your ownership.

3.3 Identification of the Allegedly Infringing Material
Provide the Trakroom URL, product page, account information, title of the product, or other information reasonably sufficient for us to locate the material.

3.4 Contact Information
Include your:

  • Full name
  • Address
  • Telephone number
  • Email address

3.5 Good-Faith Statement
A statement confirming that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law.

3.6 Accuracy and Authority Statement
A statement confirming that the information contained in your complaint is accurate and that, where applicable, you are authorized to act on behalf of the copyright owner.

Incomplete complaints may delay our ability to investigate the matter.

4. How to Submit a Copyright Complaint
Copyright complaints should be submitted to Trakroom through the official contact channel designated for intellectual property matters.

Where an official Trakroom copyright email address is designated, complaints should be submitted through that address.

5. How Trakroom Processes Copyright Complaints
After receiving a complaint, Trakroom may review the information provided to determine whether further action is appropriate.

Depending on the circumstances, Trakroom may:
* Request additional information from the reporting party.
* Contact the affected user or account holder.
* Remove or restrict access to the reported content.
* Temporarily suspend the availability of a product.
* Suspend or restrict an account.
* Permanently terminate an account in appropriate circumstances.
* Take other measures reasonably necessary to protect intellectual property rights and the integrity of the platform.

Trakroom does not guarantee that every complaint will result in removal of the reported material.

6. Notice to the Reported User
If Trakroom removes or restricts access to content because of an intellectual property complaint, we may notify the affected account holder.
Where appropriate and permitted by law, the user may receive information concerning the complaint and instructions for responding to the claim.

Trakroom may disclose information contained in a complaint when reasonably necessary to:
* Investigate or resolve the dispute;
* Comply with applicable law; or
* Protect the rights and safety of Trakroom, its users, or third parties.

7. Counter-Notice
If you believe your content was removed or restricted because of a mistake, misidentification, or because you have the necessary rights or authorization to use the material, you may contact Trakroom to dispute the action.

A counter-notice should generally include:

  1. Your physical or electronic signature.
  2. Your full name and contact information.
  3. Identification of the material that was removed or restricted.
  4. The location where the material appeared on Trakroom before it was removed.
  5. An explanation of why you believe the material was removed or restricted in error.
  6. A statement that the information provided is accurate.
  7. Confirmation that you have the necessary rights or authorization to use the material, where applicable.

Depending on the applicable law and circumstances of the dispute, additional information or legal requirements may apply.

Because submitting a counter-notice can have legal consequences, you should consult an attorney if you are unsure whether you should submit one.

8. Reinstatement of Removed Content
If Trakroom receives a valid counter-notice or otherwise determines that content was removed or restricted in error, we may restore access to the material.

However, Trakroom may continue restricting content where:

  • The reporting party provides additional evidence of infringement.
  • The user cannot establish sufficient rights or authorization.
  • The content violates another Trakroom policy.
  • The content presents legal, security, fraud, or other significant risks.
  • Applicable law requires or permits continued restriction.

Users should not simply re-upload content that has been removed for alleged infringement while the dispute is unresolved.

Repeatedly re-uploading material that has been removed may result in suspension or permanent termination of the account.

9. Repeat Infringer Policy
Trakroom may suspend or permanently terminate accounts associated with repeated or serious intellectual property violations.

Factors we may consider include:

  • The number and seriousness of complaints.
  • Whether complaints appear to be valid.
  • Whether the user repeatedly uploads previously removed material.
  • Whether the user ignores infringement notices.
  • Whether the user provides false or misleading information.
  • Whether there is evidence of a pattern of infringement.
  • Whether the account appears to exist primarily for infringing activity.

Trakroom may also take action against accounts that facilitate access to infringing material hosted elsewhere or otherwise demonstrate a repeated disregard for intellectual property rights.

10. Copyright Ownership and Seller Responsibility
Creators, sellers, producers, artists, and other users who upload content to Trakroom are responsible for ensuring that they have the necessary rights, licenses, permissions, and authority to upload, sell, license, distribute, or otherwise make that content available.

Uploading content to Trakroom does not transfer ownership of that content to Trakroom.

Users must not upload or sell:

  • Copyrighted material belonging to another person without authorization.
  • Beats, songs, samples, recordings, artwork, videos, or other content without the necessary rights.
  • Content obtained from another platform when the user does not have permission to redistribute or sell it.
  • Content that violates another person’s intellectual property rights.

Where applicable, sellers may be required to provide evidence of ownership, licensing, authorization, or other rights relating to disputed content.

11. Counterfeit Goods and Unauthorized Digital Products
Trakroom prohibits the sale or promotion of counterfeit products or unauthorized digital goods.

Examples may include:

  • Products falsely represented as being created, authorized, endorsed, or licensed by another person or brand.
  • Unauthorized copies of digital products.
  • Unauthorized distribution of paid digital content.
  • Products using another person’s brand or intellectual property in a misleading manner.
  • Unauthorized access to paid content, accounts, services, or digital products.
  • Replicas or imitations marketed in a manner intended to deceive customers about their origin or authenticity.

If Trakroom determines that an account or product violates this policy, we may:

  • Remove the content.
  • Restrict access to the product.
  • Suspend the account.
  • Permanently terminate the account.

12. Trademark Policy
Trakroom respects trademark rights.

A trademark may include a name, logo, phrase, symbol, design, or other identifier used to distinguish goods or services.

Users must not use another person's or company's trademark in a manner that falsely suggests:

  • Sponsorship by the trademark owner.
  • Endorsement by the trademark owner.
  • An official partnership.
  • Authorization by the trademark owner.
  • Ownership or affiliation that does not exist.

Use of a trademark is not automatically prohibited. Legitimate references, commentary, criticism, comparison, or other uses permitted by applicable law may not constitute infringement.

13. Trademark Complaints
Trademark complaints should generally be submitted by:

  • The trademark owner; or
  • A person legally authorized to act on behalf of the trademark owner.

A trademark complaint should include:
1. Identification of the trademark.
2. Evidence of ownership or authorization to act on behalf of the trademark owner.
3. Identification of the allegedly infringing material.
4. The location of the material on Trakroom.
5. An explanation of how the use allegedly infringes or creates confusion regarding the trademark.
6. The complainant’s contact information.
7. A statement confirming that the information provided is accurate.

Trakroom may request additional information where necessary to evaluate a complaint.

14. What Happens When a Trademark Violation Is Confirmed?
If Trakroom determines that a user has violated this policy, we may:

  • Remove or restrict the relevant content.
  • Disable a product.
  • Request that the user modify the content.
  • Suspend the account.
  • Permanently terminate the account.
  • Take other appropriate action.

The action taken will depend on the nature and seriousness of the alleged violation.

15. False or Abusive Reports
Trakroom takes intellectual property complaints seriously, but complaints must be submitted in good faith.

Do not submit a complaint simply because:

  • You dislike a particular user.
  • You disagree with a seller.
  • You want to remove a legitimate competitor.
  • You want to interfere with another person’s business.
  • You do not like a product or creative work.
  • You do not actually own or control the rights you claim.

Knowingly submitting false or materially misleading information may result in rejection of the complaint and may expose the reporting party to legal consequences.

16. No Legal Advice
Nothing in this policy constitutes legal advice.

Trakroom cannot determine legal ownership or provide legal opinions on behalf of users, rights holders, sellers, artists, producers, or other parties.

If you are unsure about your rights, whether content infringes another person’s rights, or whether you should submit a complaint or counter-notice, you should consult a qualified attorney.

17. Changes to This Policy
Trakroom may update this policy from time to time to reflect changes in our services, applicable law, or our intellectual property enforcement practices.

When appropriate, material changes may be communicated through the Trakroom website or other appropriate channels.
